1. Introduction

1.1 This is where we set out the Terms and Conditions by which we agree to supply services to you/your company

1.2 When you book or buy any service from us you agree that you will be bound by these Terms and Conditions and it is your responsibility to ensure you are familiar with them beforehand
1.3 We have complete discretion to modify, add to or remove any part of these Terms and Conditions
1.4 Our current Terms and Conditions always appear on our Website and a copy is also available on request

2. Definitions

2.1 In these Terms and Conditions ‘we’, ‘our’, ‘us’, refers to Speaking Works
2.2 ‘Website’ refers to www.speakingworks.co.uk
2.3 ‘Workshop,' ‘Session’ and ‘Training’ refers to any activity run by us:

3. Payment

3.1 Details of our fees and valid methods of payment can be given on request
3.2 Payment in advance is taken to confirm a booking of 1:1 sessions.
3.2.1 A 50% deposit will be needed for all corporate training bookings.
3.2.2 1:1 sessions cancelled within a week of the session are charged 50% of the price. 1:1 sessions cancelled within 24 hrs are charged at the full price and no refunds can be given.

4. Discounts

4.1 You may claim a student discount for 1:1 training

4.2 We may, from time to time offer other limited discounts. In such circumstances, you may only claim one discount against the cost of a workshop, 1:1 or course
4.3. You must claim the discount at the time of booking
4.4. We reserve the right to amend or withdraw discounts at our discretion


5. Admittance

5.1 All our training is designed to be enjoyed by every participant. We expect the highest standards of behaviour from everyone concerned. So if we consider the behaviour of any participant to be disruptive, violent or likely to endanger other participants or Speaking Works staff or your behaviour towards us or others connected to us, including other participants, partners or staff is inappropriate or likely to bring us into disrepute we reserve the right to exclude you from participation in or attendance at any of our sessions.

5.2 In the event of exclusion no refunds will be given and we reserve the right to pursue payment of any outstanding fees

6. Returns and Refunds

6.1 Refunds will be made via BACS
6.2 We will make an administrative charge of £5.00 in respect of unreasonably disputed credit card payments
6.3 Where a payment is returned we may exclude you from classes and workshops, until the returned payment is repaid and we reserve the right to pursue payment of any outstanding fees
6.4 No refunds will be given
6.4.1 in the event of a cancellation of a training session for any reason outside our control (e.g. inclement weather). Where a workshop is cancelled we will endeavour to offer you an alternative time at the earliest convenient opportunity convenient to us
6.4.2 where you are excluded from sessions pursuant to clause 5 above
6.5 All deposits are non-refundable

7. Liability

7.1 Our classes are provided on an ‘as is’ basis, without warranties, conditions or representations of any kind save as may be implied by law
7.2 Speaking Works is not liable for death or personal injury to any participant at any of our classes/workshops, or any activity related to us, except to the extent that such death or personal injury is caused by the negligence or default of any of our staff or any other default on our part
7.3 Speaking Works is not liable for loss of or damage to any personal property belonging to you except to the extent that such loss or damage is caused by the negligence or default of any of our partners or staff or any other default on our part
7.4 Without prejudice to the other terms of this agreement, in no circumstances will Speaking Works be liable for
7.4.1 economic losses
7.4.2 loss of goodwill or reputation
7.4.3 any other special, indirect or consequential losses or
7.4.4 loss to third parties

7.5 Nothing in these Terms and Conditions is intended to exclude or restrict Speaking Works' liability for anything which is precluded by the UK legislation from being thus excluded or restricted
7.6 Subject as may otherwise be required by UK legislation, our total liability for any loss, costs, damages or expenses or other liability shall not exceed the fees due for the services provided

8. Miscellaneous

8.1 We may take photographs or film, video or audio recordings of sessions and related activities that may be used for marketing and promotional purposes. If you do not wish to be included in these materials please let us know at the time of booking
8.2 These Terms and Conditions and any documents referred to herein form the entire agreement between us in connection with your booking, purchase and enjoyment of any of our services
8.3 A person who is not a party to these Terms and Conditions or any agreement of which these Terms and Conditions form a part shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms
8.4 If on any occasion we do not enforce a right or provision of these Terms and Conditions we shall not be deemed to have waived that right or provision
8.5 If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force and effect

11 GOVERNING LAW AND JURISDICTION (Governing Law and Jurisdiction)

11.1 This Agreement will be governed by the laws of England and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws
